Article 1 | Parties

In this Agreement, the terms “Mark Turizm”, “Company”, “Service Provider”, “we” or “website” refer to the company below, which provides Türkiye travel consultancy, visitor information, route assessment, travel preparation, payment, communication and support services through the website:

In this Agreement, the terms “User” or “person requesting the service” refer to the person who, on their own behalf or on behalf of another person they are authorized to represent, completes a form, shares information, requests Türkiye travel consultancy services, makes a payment, receives communication support or uses the services provided by Mark Turizm through the website.

If the User acts on behalf of another person, the User accepts that they are authorized to request the service, share the necessary information, conduct the consultancy process and accept this Agreement on behalf of that person.


Article 2 | Subject and Application of the Agreement

This Agreement sets out the rights and obligations relating to Türkiye travel consultancy, visitor information, personalized travel assessment, route planning, travel preparation, payment, communication and support services provided by Mark Turizm through the website.

The service type selected by the User may also be displayed on the service request screen, payment screen, fee policy page, information areas or relevant consent boxes. Before proceeding, the User is responsible for reviewing the service scope, payment items, total amount, cancellation and refund terms and the relevant information notices shown to them.

By performing a transaction through the website, submitting a form, making a payment or ticking the relevant consent boxes, the User is deemed to have accepted the provisions of this Agreement that are visible to them and applicable to the service they selected.


Article 3 | Nature of the Service

The service provided by Mark Turizm is a private travel consultancy and visitor information service for trips to Türkiye. The purpose of this service is to help the User assess their Türkiye trip in a more informed, planned and understandable way, and in line with their own expectations.

The service may be prepared by taking into account the User’s travel dates, duration of stay, number of travelers, age group, interests, city preferences, regional preferences, transport expectations, accommodation area expectations, budget range, travel pace, special sensitivities and similar information.

Information, suggestions, plans, lists and guidance provided by Mark Turizm are for information and consultancy purposes. Final travel decisions, purchases, reservations, third-party service choices and implementation of the travel plan belong to the User.


Article 4 | Service Scope

The scope of the Türkiye travel consultancy service may vary depending on the service type selected by the User, the consultancy content requested and the service descriptions shown during the transaction.

Depending on the selected service type, information, guidance, assessment or planning support may be provided on the following matters:

  • General preparation and planning assessment before a trip to Türkiye,
  • City, region, route, travel duration and daily pace assessment,
  • Route and daily program suggestions based on the User’s interests,
  • Travel notes focused on culture, history, coast, nature, shopping, food and dining, and events,
  • General guidance regarding accommodation area selection,
  • General information about urban transport, regional transport and travel flow,
  • Restaurant, cafe, museum, cultural stop, shopping area, viewpoint or event suggestions,
  • Pre-travel checklist and practical travel notes,
  • Personal travel assessment and written planning notes suitable for the User’s request,
  • Communication and guidance support that may be provided within the selected service scope.

The service scope may be limited to the package descriptions, service information, payment screen, consent areas or relevant explanatory texts shown to the User during the transaction.


Article 5 | Matters Outside the Service

The Türkiye travel consultancy service provided by Mark Turizm does not mean the sale, reservation, purchase or guarantee of third-party services such as flight tickets, hotels, restaurants, events, tours, transfers, car rental, insurance, health services, guiding services or similar services.

Mark Turizm is not obliged to enter into contracts with third-party providers on behalf of the User, make reservations, purchase tickets, make payments, fix prices, reserve availability or guarantee the outcome of third-party services.

Health, safety, legal, tax, financial matters, insurance, public notices, airline rules, accommodation provider rules, event organizer rules or third-party service terms shall not be considered a professional expertise commitment within the scope of Mark Turizm’s tourism consultancy service.


Article 6 | Service Packages

The User may select one of the Türkiye travel consultancy packages or service options offered on the website.

Packages may differ in terms of consultancy scope, service priority, support level, level of detail in the personalized Türkiye plan, preparation time, communication channel and additional guidance scope that may be provided.

Package names such as Fast, Express, Standard or similar terms refer only to Mark Turizm’s internal service priority, support response speed, content preparation scope and preparation time of the personalized Türkiye plan.

Package selection does not guarantee the availability, prices, opening hours, occurrence of events, weather conditions, transport duration or the User’s travel experience with third-party services.

Estimated preparation or delivery times stated within a package begin after the User completes the required information and payment. Missing information, late response by the User, scope change requests, technical issues, operational workload or force majeure may affect delivery times.


Article 7 | User Information and Preferences

The User is responsible for sharing the requested travel dates, travel duration, number of travelers, age group, interests, city preferences, regional preferences, transport preferences, accommodation area expectations, budget range, special sensitivities and similar information accurately, completely and up to date so that the Türkiye travel consultancy service can be prepared.

Mark Turizm shall not be responsible if the prepared plan does not match the User’s expectations due to incomplete, incorrect, outdated, false or misleading information shared by the User.

If the User’s travel preferences or conditions change, the User must inform Mark Turizm before service preparation is completed. Change requests submitted after service preparation has started or after the plan has been delivered may be assessed separately according to the service scope and availability.


Article 8 | Personalized Türkiye Plan

The personalized Türkiye plan is an information, assessment and travel preparation service offered within the selected consultancy package.

This plan may include route, transport, restaurant, cafe, shopping area, event, concert, theatre, museum, cultural route, daily program, regional comparison, return-day checklist or practical travel notes.

Suggestions included in the personalized Türkiye plan are for information and guidance purposes. Mark Turizm does not guarantee tickets, reservations, availability, prices, transport duration, occurrence of events, third-party service quality, weather conditions, crowd levels, user satisfaction or third-party service outcomes.

Support provided by phone, e-mail, messaging applications or similar channels refers to communication and guidance support within Mark Turizm’s own service scope. This support does not replace emergency health, safety, legal, financial, insurance or third-party services.


Article 9 | Informational Nature of Suggestions

Route, city, region, transport, restaurant, cafe, shopping, event, museum, cultural stop, accommodation area, daily program and travel preparation suggestions provided by Mark Turizm are for information and guidance purposes.

These suggestions may be prepared by taking into account the information shared by the User, general travel experience, publicly available information, sector assessments, user expectations and the planning carried out during the consultancy process.

Mark Turizm does not guarantee that suggested places will be open, prices will remain the same, transport times will not change, events will take place, third-party services will be provided at the expected quality or all User expectations will be met.


Article 10 | Third-Party Services

Hotels, restaurants, transport, events, museums, tours, shops, digital platforms, payment institutions, airlines, transfer providers or similar third-party services that the User may use during their trip are independent from Mark Turizm.

Prices, availability, opening hours, cancellation terms, service quality, rules and practices of third-party services are determined by the relevant third-party providers and may change over time.

Mark Turizm is not responsible for the acts, omissions, cancellations, delays, price changes, service quality of third-party providers or any disputes that may arise between the User and third parties.


Article 11 | Payment

The amount to be charged for the Türkiye travel consultancy service is shown on the payment screen or relevant service information areas according to the selected service type and payment method.

Before giving payment approval, the User is responsible for checking the service scope, total amount, any additional fees, cancellation and refund terms.

Payment may be collected by credit card, debit card, virtual POS, payment institution or other payment methods that may be offered by Mark Turizm.

Mark Turizm is not responsible for commissions, exchange rate differences, transaction fees, holds, authorizations, payment declines, security checks or transaction delays that may be applied by card schemes, banks, payment service providers or payment infrastructures.

Completion of the payment by the User may mean that the User authorizes Mark Turizm to begin preparing the consultancy service within the selected service scope.


Article 12 | Cancellation and Refund Terms

Cancellation and refund requests are assessed according to the stage of the service, whether personalized planning or assessment has started, whether content specific to the User has been prepared, whether communication support has been provided and the rules of the payment infrastructure.

  • For cancellation requests made before the consultancy service has started, the Mark Turizm service fee collected may be refunded.
  • If information review, travel assessment, route planning, personal content preparation, written note creation, support process or user-specific consultancy work has started, all or part of the Mark Turizm service fee may not be refundable depending on the scope of the service provided.
  • If a plan, assessment, list, note, guidance or consultancy output specific to the User has been prepared or delivered, the fee relating to this service may not be considered within the refund scope.
  • If there is a clear transaction error, duplicate payment or technical collection error caused by Mark Turizm, the necessary review will be carried out and an appropriate refund or correction will be made.
  • If the content prepared does not match the User’s expectations due to incorrect, incomplete, false or outdated information provided by the User, this alone does not create an automatic right to refund.
  • Refund of transaction costs deducted by a bank, card scheme, virtual POS or payment infrastructure may depend on the rules of the relevant payment provider.

The User must contact Mark Turizm for cancellation or refund requests. Each request is assessed by taking into account transaction records, payment records, service stage, prepared content and the scope of the service provided.

If the User initiates a payment dispute, reversal or chargeback, Mark Turizm may submit transaction records, service records, invoice information, communication records and other lawful records to the relevant bank, payment institution or card scheme.

If it is determined that the User used a payment dispute or chargeback mechanism in bad faith to harm Mark Turizm, obtain an unfair benefit or recover the fee for a service received, Mark Turizm may resort to legal remedies and claim compensation for its losses.


Article 13 | Preparation and Delivery of the Service

The preparation time of the tourism consultancy service may vary depending on the selected service type, the breadth of the scope requested by the User, the speed at which the User shares information, the nature of special requests and Mark Turizm’s operational workload.

Plans, assessments, lists, notes, guidance or consultancy outputs that may be provided to the User may be delivered by e-mail, website, phone, messaging applications or other communication channels deemed appropriate by Mark Turizm.

Estimated preparation or delivery times are for information purposes. If the User provides information late, shares incomplete information, requests a scope change or if exceptional workload occurs, the service delivery time may change.


Article 14 | Revision and Change Requests

The User may request reasonable clarification or correction regarding the plan, assessment, list or consultancy output provided to them.

The scope of revision or change requests is assessed according to the selected service package, delivery stage of the service, accuracy of the information initially shared by the User and the nature of the request.

If the User changes fundamental elements such as travel date, city preference, number of travelers, budget range, travel purpose, accommodation area expectation or travel pace, additional work may be required. In this case, Mark Turizm may request an additional fee or require a new service request to be created.


Article 15 | User Responsibilities

When making all decisions regarding their own trip, the User is responsible for checking their personal situation, health condition, budget, travel documents, transport plan, accommodation conditions, third-party service terms and applicable rules.

The User must assess the suggestions provided by Mark Turizm according to their own needs, safety, budget, physical condition and travel circumstances.

Before purchasing any third-party service, making a reservation, buying a ticket or finalizing a travel plan, the User is responsible for checking the relevant provider’s current terms, fees, cancellation conditions and availability.

During the trip, the User is responsible for complying with applicable rules, local regulations, third-party service provider terms and safety notices.


Article 16 | No Guarantee

Mark Turizm does not guarantee that the User’s travel experience will take place at a certain quality, that suggested places will be open, that prices will not change, that transport will be completed within a certain time, that events will take place, that third-party services will be provided without interruption or that all expectations of the User will be met.

Plans, lists, notes, routes or suggestions prepared by Mark Turizm are consultancy outputs prepared to support the User. These outputs are not a guarantee of the travel outcome or of third-party services.

The User accepts that, by the nature of the Türkiye travel consultancy service, some conditions may change over time, travel plans may be affected by external factors and the responsibility for final decisions belongs to the User.


Article 17 | Communication and Support

Mark Turizm may send notifications relating to the tourism consultancy service through the e-mail address, phone number, SMS, website, messaging applications or other communication channels provided by the User.

The User is responsible for ensuring that their contact details are accurate and accessible. Mark Turizm is not responsible for delays that may occur because contact details such as e-mail or phone number are provided incorrectly, messages do not reach the User, e-mails fall into spam filters or the User fails to follow notifications.

Support that may be provided by phone or messaging applications refers only to information and guidance support within Mark Turizm’s own service scope. This support does not replace emergency health, safety, legal, financial, insurance or third-party services.


Article 18 | Intellectual Property and Usage Limits

Travel plans, route notes, lists, assessments, texts, visuals, tables, checklists, recommendation documents and similar consultancy outputs prepared by Mark Turizm may be considered part of Mark Turizm’s content production.

The User may use the consultancy output prepared for them only for personal travel planning purposes. Without Mark Turizm’s written permission, such content may not be reproduced, sold, distributed, published or used to provide services to third parties for commercial purposes.

Personal preferences, explanations, travel notes or special information submitted by the User to Mark Turizm within the scope of the travel consultancy service may be used for preparation of the service and communication with the User.


Article 19 | Personal Data and Privacy

Mark Turizm may process the User’s name, surname, contact details, travel dates, travel preferences, number of travelers, interests, special requests and other information required by the service in order to provide the Türkiye travel consultancy service.

Details regarding the processing of personal data may be regulated separately in the privacy policy, cookie policy, disclosure texts or relevant information areas published on the website.

The User accepts that the information shared when requesting the service is accurate and up to date, and that the information required for preparation of the service may be used by Mark Turizm.


Article 20 | Prevention of Abuse

Mark Turizm may review transaction records and suspend the service in cases of payment security, service security, fraud risk, abuse, duplicate transaction, suspicious transaction or suspected unlawful use.

If the User shares false, misleading, bad-faith information or information that violates third-party rights; uses payment instruments without authorization; makes a bad-faith payment dispute despite receiving the service; or acts in a way intended to harm Mark Turizm, Mark Turizm may terminate the service and exercise its legal rights.

In response to lawful requests, Mark Turizm may share transaction records, payment records, communication records and service records with competent authorities, banks, payment institutions or card schemes.


Article 21 | Force Majeure

Natural disasters, epidemics, war, terrorism, civil unrest, strikes, technical failures, internet outages, power outages, payment infrastructure failures, decisions taken by public authorities, transport disruptions, problems in the systems of third-party service providers or similar circumstances beyond Mark Turizm’s reasonable control may be considered force majeure.

In force majeure situations, Mark Turizm’s service delivery times, communication times, content preparation process or support process may be affected. In such cases, Mark Turizm cannot be held responsible for delays or temporary interruption of the service.


Article 22 | Limitation of Liability

To the extent permitted by applicable law, Mark Turizm’s liability within the scope of the tourism consultancy service is limited to direct damages arising from its own fault.

Flight tickets, hotels, transport, reservations, events, tours, third-party service fees, changes in travel plans, loss of time, loss of income, loss of business, unmet holiday expectations or similar indirect damages are not considered within this scope.

Mark Turizm is not responsible for consequences arising from the User’s own decisions, practices of third-party service providers, changing travel conditions, incorrect or incomplete information provided by the User, or the User’s failure to assess Mark Turizm’s suggestions according to their own circumstances.


Article 23 | Amendments to the Agreement

Mark Turizm may update this Service Agreement from time to time. The updated Agreement becomes effective from the date it is published on the website.

The Agreement available on the website on the date the User gives payment or service approval shall apply to the relevant transaction. Unless expressly stated otherwise, amendments to the Agreement shall not apply retroactively to past transactions.


Article 24 | Governing Law and Disputes

This Agreement shall be interpreted under the laws of the Republic of Türkiye. The User’s mandatory rights arising from applicable law are reserved.

In the event of a dispute, it is recommended that a solution first be sought through Mark Turizm support channels. The parties’ legal application rights are reserved.


Article 25 | Acceptance and Approval

By requesting a service through the website, submitting a form, making a payment or ticking the relevant consent boxes, the User declares that they have read, understood and accepted this Service Agreement.

The User accepts the following:

  • The service provided by Mark Turizm is a private Türkiye travel consultancy and visitor information service,
  • Suggestions provided within the service are for information and guidance purposes,
  • Final travel decisions and third-party service choices belong to the User,
  • The User gives approval after reviewing the service scope, payment items, total amount, cancellation and refund terms,
  • The information shared by the User is accurate, complete and up to date,
  • Mark Turizm does not guarantee the outcome, price, availability or quality of third-party services,
  • If a personalized plan or consultancy output has been prepared, the fee relating to this service may not be considered refundable.
